Privacy Policy and Confidentiality Agreement

This Privacy Policy sets out how the Naturalis Aequitas Common Law Community (NACLC), an unincorporated private members association, collects, uses, protects, and manages Member information.

By applying for or participating in NACLC, each Member agrees to the terms of this Privacy Policy.


1. Nature of the Community and Privacy Expectation

NACLC operates as a private membership-based community. Participation involves interaction, discussion, and exchange of information within a restricted environment.

Members acknowledge that a heightened standard of privacy and confidentiality applies to all Member information, communications, and materials shared within the community.


2. Information Collected

NACLC may collect and retain:

  • Personal details provided during application (such as name, contact information, and country of residence);
  • Statements of interest and disclosed affiliations;
  • Communications, contributions, and interactions within the community;
  • Technical or usage data necessary for administration of the platform.

Information is collected only to the extent reasonably required for membership administration, community operation, and integrity.


3. Purpose of Use

Information collected is used solely for:

  • Assessing and administering membership;
  • Maintaining the integrity and security of the community;
  • Facilitating communication between Members;
  • Managing and improving the operation of NACLC.

NACLC does not sell, trade, or commercially exploit Member information.


4. Confidentiality of Member Information

All Member information is treated as strictly confidential.

NACLC will take reasonable steps to:

  • Protect Member data from unauthorised access, disclosure, or misuse;
  • Limit access to information to persons responsible for administration of the community;
  • Maintain appropriate technical and organisational safeguards.

5. Mutual Non-Disclosure Obligations

As a condition of membership, confidentiality is mutual and binding.

Each Member agrees that:

  • Information relating to other Members, including identity, communications, and participation, is private and must not be disclosed outside the community without express consent;
  • Community discussions, materials, and exchanges are not to be recorded, reproduced, or distributed externally without authorisation;
  • Information obtained through membership must not be used for external enforcement, investigation, commercial gain, or adversarial purposes.

NACLC likewise undertakes to maintain the confidentiality of Member information, subject to lawful obligations.


6. Limited Disclosure Exceptions

Confidentiality obligations apply except where disclosure is required:

  • By applicable law or valid legal process;
  • To prevent serious harm or unlawful activity;
  • With the explicit consent of the Member concerned.

Where reasonably practicable, NACLC will seek to limit the scope of any required disclosure.


7. Data Retention

Member information will be retained only for as long as reasonably necessary to:

  • Maintain membership records;
  • Support ongoing participation;
  • Comply with legal or administrative obligations.

Upon termination of membership, NACLC may retain limited records where necessary for compliance, dispute resolution, or enforcement of contractual obligations.


8. Member Responsibility for Security

Members are responsible for maintaining the confidentiality of their own access credentials and for any activity conducted under their account.

Members must notify NACLC of any suspected unauthorised access or breach of security.


9. Breach of Confidentiality

Unauthorised disclosure or misuse of confidential information constitutes a serious breach of membership obligations.

Where such breach results in harm to NACLC or its Members, the responsible Member may be subject to:

  • Suspension or termination of membership;
  • Liability under the Membership Terms of Service, including indemnity provisions;
  • Resolution of disputes through agreed arbitration processes.

10. International Participation

Members acknowledge that NACLC operates across jurisdictions. By participating, Members consent to the handling of information in accordance with this Policy, subject to applicable laws.


11. Policy Updates

NACLC may update this Privacy Policy from time to time to reflect operational or legal requirements. Continued participation constitutes acceptance of any updated terms.


12. Acceptance

By applying for membership and participating in NACLC, the Member acknowledges that:

  • This Privacy Policy has been read and understood;
  • The Member agrees to both the protection of personal information and the mutual confidentiality obligations set out above.
